  • One of the most significant aspects of any Arizona divorce or legal separation is the division of property and debts. Arizona is a community property state, which means that assets and obligations acquired during the marriage are generally presumed to belong equally to both spouses, regardless of whose name appears on the title, account, or debt. Community property may include real estate, retirement accounts, bank accounts, business interests, vehicles, investments, and other assets acquired during the marriage. Likewise, debts incurred during the marriage are generally considered community obligations subject to equitable division by the Court.


  • Not all property is subject to division. Property owned by a spouse before the marriage, as well as certain gifts and inheritances received during the marriage, may be considered separate property and remain the sole property of that spouse unless it has been commingled or otherwise converted into community property. When dividing assets and debts, Arizona courts strive for a substantially equal distribution while considering the unique circumstances of each case. Complex issues often arise involving business ownership, retirement accounts, real estate equity, reimbursement claims, and the characterization of separate versus community property. Careful analysis and proper documentation are critical to ensuring that each party's property rights are protected and that the final division is fair and legally enforceable.
